pozabl, Inc. ("Company," "we," "us," or "our") provides music production software and services through our terminal application, web platform, mobile applications, and marketplace (collectively, the "Service"). By accessing or using the Service, you ("User," "you," or "your") agree to be bound by these Terms of Use.
1. Acceptance of Terms
By downloading, installing, accessing, or using pozabl, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
pozabl is a music production platform that enables users to create, edit, and distribute audio content. The Service includes:
- pozabl Terminal: Command-line music production tool
- pozabl Web: Browser-based music creation interface
- pozabl Mobile: Mobile application for music production
- pozabl Marketplace: Platform for buying and selling beats and audio content
3. User Accounts and Subscriptions
3.1 Account Registration
You may be required to create an account to access certain features. You agree to provide accurate information and keep your account credentials secure.
3.2 Subscription Tiers
- FREE: Limited features with monthly credit allocation
- CREATOR ($49/month): Enhanced features and credits
- PRODUCER ($99/month): Full features and unlimited local processing
3.3 Billing and Cancellation
Subscriptions are billed monthly. You may cancel at any time, with access continuing until the end of your billing period. No refunds for partial months.
4. User Content and Ownership
4.1 Your Content
You retain all ownership rights to original content you create using the Service. pozabl claims no ownership over your creations.
4.2 License to pozabl
By using the Service, you grant pozabl a limited, non-exclusive license to process your content solely for the purpose of providing the Service.
5. Prohibited Uses
You agree NOT to use the Service to:
- Create, upload, or distribute content that infringes any copyright, trademark, or other intellectual property rights
- Sample, reproduce, or incorporate copyrighted material without proper authorization
- Create content that is defamatory, obscene, or promotes illegal activity
- Attempt to reverse engineer, decompile, or extract source code from the Service
- Use automated systems to access the Service in violation of these Terms
- Circumvent any technological measures designed to protect the Service
6. Intellectual Property Compliance
You are solely responsible for ensuring that your creations do not infringe on any third-party copyrights, trademarks, patents, or other intellectual property rights.
pozabl does not monitor User Content for copyright compliance and makes no representations regarding the legality of your creations.
7. Indemnification
You agree to indemnify, defend, and hold harmless pozabl, Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Content you create, upload, or distribute using the Service
- Your violation of these Terms
- Your violation of any third-party rights
This indemnification obligation survives termination of your account.
8. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind. pozabl does not warrant that the Service will be uninterrupted or error-free.
In no event shall pozabl be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid in the twelve months preceding the claim, or $100, whichever is greater.
9. Dispute Resolution
These Terms are governed by the laws of the State of Nevada. Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association.
You agree to resolve disputes on an individual basis and waive any right to participate in a class action.
10. Termination
You may terminate your account at any time. We may suspend or terminate your access for violation of these Terms or any reason at our discretion. Upon termination, your license to use the Service ends immediately.

- Audio content from your creations (stays local unless you share it)
- Microphone data (only processed locally during recording)
- Personal files outside of pozabl projects

California residents have additional rights including the right to know what personal information is collected and the right to opt-out of data sales (we don't sell data).

EU and UK residents have rights under GDPR including access, rectification, erasure, and data portability.

This End User License Agreement ("EULA") is a legal agreement between you and pozabl, Inc. for the use of pozabl software and related services.
1. Grant of License
Subject to the terms of this EULA and payment of applicable fees, pozabl grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the pozabl software on devices you own or control
- Use the Service for personal or commercial music production
- Create, save, and export audio content
2. License Restrictions
You may NOT:
- Copy, modify, or distribute the software
- Reverse engineer, decompile, or disassemble the software
- Rent, lease, lend, or sublicense the software
- Remove or alter any proprietary notices
- Use the software for illegal purposes
- Circumvent any licensing or copy protection mechanisms
3. Ownership
The software is licensed, not sold. pozabl retains all right, title, and interest in the software, including all intellectual property rights. You own the content you create using the software.
4. Updates and Support
pozabl may provide updates, patches, or new versions at its discretion. Support is provided according to your subscription tier.
5. Termination
This license is effective until terminated. It will terminate automatically if you fail to comply with any term. Upon termination, you must cease all use and delete all copies of the software.
6. Disclaimer of Warranties
The software is provided "as is" without warranty of any kind. pozabl disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
pozabl shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the software.

pozabl, Inc. respects the intellectual property rights of others and expects users to do the same. We comply with the Digital Millennium Copyright Act (DMCA).
1. Reporting Copyright Infringement
If you believe that content on the pozabl Marketplace or Service infringes your copyright, please submit a DMCA takedown notice containing:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed
- Identification of the material to be removed with sufficient detail to locate it
- Your contact information (address, phone, email)
- A statement that you have a good faith belief the use is not authorized
- A statement under penalty of perjury that your notice is accurate and you are authorized to act

4. Repeat Infringers
pozabl maintains a policy of terminating accounts of users who are repeat copyright infringers in appropriate circumstances.
